1. The Defendant: (a) KRW 39,504,60, and the Plaintiff’s KRW 15% per annum from May 24, 2019 to May 31, 2019; and (b) June 1, 2019.

1. The Plaintiff and the Defendant traded glass products from around 2017 to October 25, 2018. However, the Plaintiff supplied the Defendant with a total of KRW 229,504,600, but only received KRW 190,000 from the Defendant until February 2, 2019. The Plaintiff sought payment of the unpaid amount of KRW 39,504,60 (=229,504,600 – KRW 190,000).

2. Judgment by no pleading of applicable provisions of Acts (Article 208 (3) 1 of the Civil Procedure Act);

Since the provisions on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning Expedition, etc. of Partial Dismissals were amended, and the statutory interest rate was changed from June 1, 2019 to 12% per annum, the portion of the claim for damages for delay seeking payment in excess of the statutory interest rate is dismissed.
