1. The Defendant shall pay to the Plaintiff KRW 44,023,544 and the interest rate of KRW 20% per annum from August 20, 2014 to the day of full payment.
Reasons
1. Basic facts
A. (1) On October 13, 201, the Korea Foundation Construction Co., Ltd. (hereinafter “Korea Foundation Construction”) was awarded a contract for the construction of a kindergarten building on the land outside B and three lots except B (hereinafter “instant building”) by setting the construction cost as KRW 1.37 billion from the Defendant on October 13, 2011.
Korean comprehensive construction was completed after the commencement of the construction work on October 201, but the construction was suspended on February 2012 due to disputes with the defendant, and the defendant directly performed part of the construction work.
B. On May 2012, Luxembourg, the construction of the instant building was completed on September 2012 by setting the construction cost of KRW 63.6 million between the Defendant and the Defendant, and entered into the instant construction contract for the construction of the instant building (excluding the aforementioned construction works directly performed by the Defendant; hereinafter “instant construction”). The instant construction was completed on or around September 2012.
