1. Basic facts

A. The Seoul Jung-gu Seoul is an aggregate building of 6th and 15th underground, and the parking lot and machinery room from 6th to 3th underground, the electric room from 2th underground to 1st underground, the commercial building and the parking lot from 2nd underground to 6th underground, the commercial building from 2nd underground to 6th ground, the commercial building from 3rd underground, the commercial building from 2nd and 8th above ground, the residential facilities, the 7th and 8th above ground, the general business facilities (the 10th above ground is the Plaintiff’s office), the 11th to 15th above ground, and the Plaintiff was established for the purpose of maintaining, managing, and revitalizing the commercial building on December 11, 199.

B. On September 15, 200, the Plaintiff submitted relevant documents to the head of Jung-gu Seoul Metropolitan Government (hereinafter “the head of Jung-gu”) who is the competent administrative agency pursuant to Article 13(1) and (2) of the former Distribution Industry Development Act (wholly amended by Act No. 6959, Jul. 30, 2003; hereinafter “former Distribution Industry Development Act”) and Article 7(1) of the former Enforcement Rule of the Distribution Industry Development Act (wholly amended by Ordinance of the Ministry of Commerce, Industry and Energy No. 236, Jun. 22, 2004; hereinafter “Enforcement Rule of the former Distribution Industry Development Act”) in order to report the part from the second to nine stories above ground, and the head of Jung-gu, Seoul Metropolitan Government (hereinafter “the head of Jung-gu”) in order to verify the consent of shop occupants on September 18, 200.

C. On November 2, 200, the Plaintiff filed a supplement to the documents and filed a report again with the head of the Jung-gu Office as a superstore manager of the C building. On November 13, 2000, the head of the mid-gu office accepted the said report and notified the Plaintiff as a superstore manager of the C building, and issued a superstore establishment registration certificate and a written confirmation to the Plaintiff as to the part from the second to nine floors above the ground.

The head of Jung-gu shall, even on November 26, 2004, make the above superstore to the Plaintiff.
