1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On June 24, 2014, based on the authentic copy of a promissory note with executory power of No. 140, 2014, the Plaintiff was issued an attachment and assignment order of the claim amounting to KRW 35,000,000 (hereinafter “instant assignment order”) with respect to the payment claim against Hongsung-gun as a notary public against B on June 24, 2014, and the said order was served on the garnishee on June 26, 2014, and on the obligor on July 11, 2014.
B. On May 15, 2015, Defendant Nonghyup Bank Co., Ltd. (hereinafter “Defendant Nonghyup Bank”) received a claim amounting to KRW 10,397,191 (this court 2015TTT) based on the original copy of the individual rehabilitation creditors’ list with executory power in the Daejeon District Court 2013 Session 30327, and issued a seizure and collection order (this court 2015TTT 6069), and the said order was served on Hong-gun on May 19, 2015.
C. On May 19, 2015, Defendant South Korea Bank Co., Ltd. (hereinafter “Defendant South Korea Bank”) issued a seizure and collection order (this court 2015TTT 1396) with respect to the above benefit claim amounting to KRW 7,010,367 based on the executory decision of Daejeon District Court 2013 303 30327 individual rehabilitation cases. The above order was served on Hong-gun on May 21, 2015.
On April 20, 2015, Defendant SB Savings Bank Co., Ltd. (hereinafter “Defendant SB Savings Bank”) received a claim amounting to KRW 5,631,215 (this court 2015 other 1123), based on the executory decision of the Daejeon District Court 2013 Ma30327 on the executory decision of the individual rehabilitation case. On April 20, 2015, Defendant SB Savings Bank received a claim amounting to KRW 5,631,215, and the above order was served on Hongsung-gun on April 22, 2015.
E. Hong-gun, the garnishee, deposited KRW 1,778,515 of the wage obligation amount, and Defendant SBA Savings Bank, the collection authority holder, on the date of distribution on August 26, 2015 of the distribution procedure case of Daejeon District Court Red support 2015 another distribution procedure case of KRW 1,760,765 of the actual amount to be distributed.
