A defendant shall be punished by imprisonment for a term of one year and three months.

Punishment of the crime

[criminal power] On May 31, 2010, the Defendant was sentenced to a fine of two million won for a violation of the Road Traffic Act (driving) at the credit branch of Suwon District Court on May 31, 2010; on June 18, 2012, at the Daegu District Court Kimcheon Branch, a fine of one million and five million won for the same crime; and on November 2, 2017, the Defendant was sentenced to imprisonment of eight months for the same crime in the same court, and completed the execution of the sentence in the Daegu Prison on April 20, 2018.

【Criminal Facts】

1. Around 14:00 on April 19, 2020, the Defendant, while under the influence of alcohol by 0.171%, driven a blood alcohol-related car at around 0.171%, operated a two-way 17 south-ro, Gu, Nowon-gu, Seoul Special Metropolitan City (Seoul Special Metropolitan City) on the side of a C apartment room, straighter part of the victim D(40 years old) driving, which was waiting at the front bank of the mast, was going to the front part of the Defendant’s driver’s vehicle. On the other hand, the Defendant got the front part of the said victim D’s Epis car, which was pushed from the front part to the front part, and led the victim F(66 years old)’s drive under the influence of traffic in the front part.

As a result, the Defendant driven the said car in a state where normal driving is difficult due to influence of alcohol, and suffered injury to the victim D, such as the injury of treatment days, the injury of the bones, tensions, etc. of the bones of wood, which requires treatment for about three weeks to the victim F, and the victim H (the 63 years old), who was the son, was in need of treatment for about three weeks.

2. The Defendant violated the Road Traffic Act (driving) at the above date, driving the said vehicle under the influence of alcohol by 0.171% of the blood alcohol concentration from the section of approximately 2.5 km to the above place from the front day of the lebsium restaurant in the old-si-si line.

Accordingly, the defendant violated the prohibition of drinking driving more than twice.
