A defendant shall be punished by imprisonment for one year.
However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime
"2016 Highest 6421"
1. On June 7, 2016, the Defendant made a false statement to D, the executive director of the victim LAC (hereinafter “victim”) who is an importing agricultural product distributor in the vicinity of the subway No. 1, Dongmdong, Bupyeong-gu, Incheon, which is 10, stating that “I will purchase a body on the face of the week to pay KRW 7,308,000 to F so that I would receive the delivery from the LAF and pay the price.”

Around June 8, 2016, the Defendant deceivingd the above D and transferred KRW 7,308,000 from the victimized Company to the Agricultural Cooperative Deposit Account in the name of F, as the price for goods around June 8, 2016, the Defendant required G, who was the above (State) F operator, to remit KRW 7,306,200 out of the said money to the Defendant’s deposit account in the name of the National Bank of Korea under the name of F, around June 8, 2016.
2. On June 10, 2016, the Defendant made a false statement to the above D, “The 360 straws will be paid by I in order to supply the body box to I who is a trading partner, and if you supply the body box 360” to I.
However, at the time of fact, the defendant was supplied with physical interest as if the defendant was directly supplied with I, and was thought to be used for the repayment of the defendant's existing obligation after receiving physical interest from I, and there was no intention or ability to pay the price of delivered goods to the damaged company.
Defendant deceiving the above D as above, and caused the victimized company to deliver 18 million won at the market price around June 13, 2016 to I. The Defendant had I deliver 360 amblings equivalent to 18 million won at the market price.
