Reasons

Punishment of the crime

1. On November 20, 2016, the Defendant was driving a G benz car at approximately KRW 200 meters from the D’s underground atmosphere parking lot located in Busan-gu, Busan-gu, without a driver’s license, from around 13:50 on November 20, 2016 to the front of the F Hospital located in Busan-gu E.

2. Violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) was a person engaging in driving a Genz car, driving the said vehicle around November 20, 2016 at around 13:50, and driving the said vehicle in front of the F Hospital E located in Busan Metropolitan Government on the road from the DMobel underground parking lot to the intersection, moving the runway toward the direction of the B-lane, and changing the course to the two-lane following one-lane.

In such cases, a person engaged in driving of a motor vehicle shall not drive a motor vehicle without a driver's license and shall not change course when it is likely to impede normal traffic of other motor vehicles running in the direction of changing the lane, and he/she has a duty of care to give advance notice of change of course and to prevent accidents by safely changing the lane while driving the direction in advance and properly considering the traffic situation.

Nevertheless, the Defendant neglected this, while driving the said vehicle without a driver’s license and changing the course from the said vehicle to the same one-lane, and the Defendant’s vehicle stopped along the same direction. The Defendant was placed on the left side of the Defendant’s vehicle with the victim’s H driving that sees the change of course by the Defendant’s vehicle.

As a result, the defendant suffered from occupational negligence the injury of finite finites, which requires approximately two weeks of medical treatment.
