The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. The judgment of the court below which found the defendant guilty of the facts charged in this case is erroneous in misunderstanding of facts or misunderstanding of legal principles, although the facts alleged by the defendant are true and public interest.
B. Unless otherwise specified in the judgment of the court below, the punishment of the court below (two million won of fine) is too unreasonable.
2. Determination
A. As to the assertion of mistake of facts or misapprehension of legal principles, the Defendant’s statement is: ① the statement to the purport that “the Defendant has given 10 copies of a ballot paper to the victim E at the time of the election of the representative; ② the victim D was elected as the 402 Dong representative due to the victim E’s involvement; ② the content of the statement to the effect that the victim D was aware that he was expelled from the same representative due to unlawful acts in the process of the election of the representative; ③ the content of the document to the effect that the victim D knew that he was expelled from the same representative due to unlawful acts in the process of the election of the representative; and ③ the content of the statement to the effect that the victim D was not able to properly perform his role as the representative, such as complying with the victim E’s opinion without any condition.
We examine whether the above stated facts are false or not.
The victim E stated that the investigative agency did not receive 10 copies of a ballot paper from the defendant at the time of the election of the same representative, and the victim D was elected and performed the same representative for about one year after the election and did not follow the management rules, the victim E unilaterally announced that the above victim was expelled from the same representative.
On the other hand, G, the defendant's wife, was given 10 copies of the ballot paper to the victim E at the time of the representative election, and the victim D was an illegal election.
