1. Facts of recognition;

A. The Plaintiff is an insurer who has entered into an automobile insurance contract with respect to C Passenger Vehicles (hereinafter “Plaintiff”), and the Defendant is a mutual aid business entity who has entered into a mutual aid agreement with respect to Dsi (hereinafter “Defendant”).

B. On June 5, 2017, around 03:27, the Plaintiff’s vehicle conflict with the Defendant’s vehicle parked in order to immediately turn to the left from the F BuildingG site to the H complex area of the F Building, while the Plaintiff was working to the left at the intersection near the Hannam-si, the Hannam-si, and in accordance with the new subparagraph.

2. The parties' assertion

A. The Plaintiff’s assertion that the Plaintiff’s vehicle left left pursuant to the new subparagraph, and the instant accident occurred with the wind to enter the intersection after the passage of the pedestrian crosswalk as the driver of the Defendant’s vehicle turns left the left, and the instant accident was entirely caused by the negligence of the Defendant’s driver.

B. The driver of the Plaintiff’s vehicle alleged by the Defendant caused the instant accident at the wind that disregards the direction line in the intersection and makes the sub-sections, so the driver of the Plaintiff’s vehicle is 50% of the negligence of the Plaintiff’s driver

3. Determination

A. The following circumstances acknowledged by the above facts and the evidence revealed earlier, namely, ① the driver of the Defendant vehicle, while proceeding in violation of the stop signal and stopping at the intersection, conflict with the Plaintiff vehicle while stopping at the intersection; ② the driver of all vehicles, when intending to turn to the left, shall turn to the left at the intersection along the center line of the road (Article 25(2) of the Road Traffic Act), but the driver of the Plaintiff vehicle is a small turning to the center line at the speed.
