A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant is a person engaging in driving a vehicle B in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Bodily Injury resulting from dangerous driving).

On May 29, 2020, the Defendant driven the above vehicle while under the influence of alcohol level of 0.118% from blood alcohol level around 10:40 on May 29, 2020, and led to a change of course to a one-lane of two lanes in front of Pyeongtaek-si C, along the two-lane from the shot seat in front of Pyeongtaek-si.

그럼에도 피고인은 술에 취하여 이를 게을리 한 채 1 차로 쪽으로 진로를 변경한 과실로 1 차로에서 직진 주행 중인 피해자 E( 남, 63세) 이 운전하는 F 싼 타 페 승용차의 우측 앞부분을 자신의 량 좌측 앞 범퍼 부분으로 충격하였고, 그 충격으로 싼 타 페 차량이 맞은편 중앙선을 넘어 튕겨 나가면서 맞은편 차로에서 정차 중이 던 피해자 G( 남, 55세) 이 운전하는 H 모 하비차량과 그 뒤에 정차 중인 피해자 I( 남, 37세) 가 운전하는 J K5 차량, 그 뒤에 정차 중인 피해자 K( 남, 43세) 이 운전하는 L 싼 타 페 차량의 좌측 측면 부분을 연달아 충격하게 하였다.

2. The Defendant is in violation of the Road Traffic Act (divated driving) with a alcohol concentration of 0.118% in the blood transfusion during the daylight under paragraph (1).
