Reasons
Punishment of the crime
1. "2012 Highest 1112";
A. A. On September 4, 2012, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) (hereinafter referred to as the “Aggravated Punishment, etc.”) (hereinafter referred to as the “AD”) was on duty to drive D Poter in the state of alcohol concentration of 0.327% while driving the D Poter in the state of being under the influence of normal driving on the part of 0.327%, and driving the D Poter in the direction of Kimcheon-si in the direction of the central box of Kimcheon-si at the port of Busan, the Defendant neglected his duty to do so at the front of the E Poter in the state of drinking and got the front part of the E Poter vehicle driven in the front of the said cargo vehicle to receive the front part of the E Poton-gu driver’s license, which was driven by the victim of G (the victim of G 32 years old) who stopped in the front of the said vehicle.
As above, the Defendant driven the above cargo in a situation where normal driving is difficult due to influence of drinking, and suffered injury to the victim, such as crypum dump, which requires treatment for about two weeks.
B. On November 5, 2012, the Defendant driven the above cargo while under the influence of 0.327% alcohol at the time and place like paragraph (1) of this Article. (2) On November 5, 2012, the Defendant driven the above cargo while under the influence of 0.258% of blood alcohol concentration without obtaining a driver’s license on the Seoul Food Road located in Kimcheon-si, Kimcheon-si.
2. On September 14, 2012, the Defendant was sentenced to 8 months of imprisonment with labor for a violation of the Road Traffic Act in the Daegu District Court Kimcheon-dong Branch on September 14, 2012, and on September 20, 2012, on September 20, 2012, the Defendant filed an appeal and is currently pending in the appellate trial, and the Daegu District Court Kimcheon-cheon Branch on December 24, 2012.
