1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff, including the part resulting from the supplementary participation.
Reasons
1. Basic facts
A. On September 9, 2016, the Plaintiff filed a petition for correction trial with the Intellectual Property Trial and Appeal Board (2016No. 101) to correct the claims of the instant patent invention as described in Paragraph 1(b)(4) below.
2) On February 10, 2017, the Korean Intellectual Property Tribunal rendered the instant trial ruling dismissing the Plaintiff’s petition for correction on the ground that “the Plaintiff’s petition for correction trial is not only within the scope of the specification or drawings of the instant patent invention, but also the claims are denied by prior inventions 1, 3, and 4, which are corrected by the petition for correction trial, and thus, the Plaintiff’s petition for correction trial is in violation of Article 136(4) of the Patent Act.” (b) The name of the instant patent invention (Evidence 2) invention: 2) the filing date / the priority date / the registration date / the registration number : the filing date : the filing date of the optical board 12/ 2012, and the patent applicant’s petition for correction trial is inconsistent with the protection of the Plaintiff’s claims 1 and 2 (No. 13935/4, Apr. 23, 2012).”
