Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

From July 1, 2008, the Defendant worked as the manager of the management division of the “D Hospital” located in the Busan Seo-gu Hospital (hereinafter “D Hospital”) from around July 1, 2008, and was in charge of overall management, such as hospital manpower and administration, according to the direction of E operating the said hospital.

1. On the other hand, in case where the National Health Insurance Corporation directly operates a restaurant by means of direct employment of human resources necessary for the meals of inpatients at a medical care institution equipped with the human resources and facilities prescribed by the Medical Service Act and the Food Sanitation Act, the National Health Insurance Corporation ordered the defendant to receive additional dues from the National Health Insurance Corporation, by employing at least two dietitians at a hospital level which directly operates the cafeteria, and by employing at least 550 additional dues for the first restaurant for inpatients, and at least 500 additional dues for the case where two or more cooks are employed to provide meals to the hospitalized patients, and by employing at least 50 additional dues for the case where the meals are provided to the hospitalized patients, the facts are calculated and paid to each medical care institution.

Around August 2008, the Defendant and E conspired to entrust the operation of a restaurant to the above G, while receiving KRW 150,000,000 from F, the representative of G, under the name of a deposit, and concluded a contract for the entrusted operation of a restaurant, the Defendant and E made a false report to the effect that he/she directly operates the restaurant at the instant hospital according to the direction of E and directly operates the restaurant at the instant hospital and directly employs two dietitians and two cookss to work full-time by employing them.
