The defendant's appeal is dismissed.
Reasons
1. Summary of grounds for appeal;
A. Although there is a fact that the defendant misjudgments the victim E in a single manner, there is no fact that the defendant gets the head of the victim due to beer's disease.
Nevertheless, the judgment of the court below that convicted the defendant of the facts charged of this case is erroneous in mistake of facts.
B. The sentence imposed by the court below on the defendant (one year and six months of imprisonment) is too unreasonable.
2. In full view of the following circumstances acknowledged by the lower court’s judgment and the evidence duly admitted and examined by the lower court as to the assertion of mistake of facts, the Defendant may recognize the fact that the victim’s face was taken several times due to drinking and salvine as stated in the facts charged, and that the victim’s head was taken back due to beer’s disease.
The defendant's above assertion of mistake is not accepted.
A. The victim E consistently stated, from the investigative agency to the court of the court below, that “the injured party’s fright to the floor was exposed to the victim by leaving him on the floor, and the Defendant was frighted, such as I, and the Defendant was satise and her fright clubwater, and the victim went back to the room out of the room. The victim was fright outside of the room, but the Defendant blicked with beer and her head.”
B. The witness I of the lower court, who observed the situation at the time, stated that the Defendant was clearly aware that the Defendant was sculing the victim’s head due to beer disease.
(Public trial records 49 pages). However, I stated that the defendant's head at the time of the victim's head as be beerer's disease "at least where it is possible to memory?" and there is a little difference from the victim's above statement. However, the defendant was at the time of the victim's main in the age club room, and the defendant was at the time at the time of other daily behaviors and the age club washes the defendant.
