1. The Defendant’s executory exemplification of the payment order No. 2015 tea 10186 dated October 8, 2015 against the Busan District Court (C).

1. Basic facts

A. On October 8, 2015, the Defendant seized each of the items listed in the separate sheet in Ulsan District Court D on November 12, 2015, based on the executory exemplification of the payment order (hereinafter “instant payment order”) issued by Busan District Court Decision 2015 tea10186 (hereinafter “instant payment order”).

B. C and E borrowed KRW 300 million from the Plaintiff on July 20, 2015 at the rate of 35% per annum.

C. On August 6, 2015, the Plaintiff entered into a contract for the transfer of movable property and goodwill with the following terms: (a) the Plaintiff entered into a contract for the transfer of movable property and goodwill; and (b) the said contract for the transfer of movable property and goodwill (hereinafter “transfer contract”) on the same day.

The notary public obtained the authentication of a deed signed by a private person in 2015 and 1187, such as the original rate of the law firm.

2. Determination as to the cause of action

가. 위 인정 사실에 의하면, 별지 목록 기재 각 물건 중 양도계약서에 양도목적물로 명시된 『C이 운영하는 울산 울주군 D에 있는 ‘F식당’에 있는 냉동고냉장고 3대(8평 1대, 2평 2대), 세척기 2대, 돌솥밥솥 32구 1세트, 냉면 기기 1세트(3개), 주방 집기 일체』에 해당하는 물건은 원고가 C과 ‘동산 및 영업권 양도계약’을 체결하고, 점유개정의 방법으로 인도받은 원고의 소유 물건이다.

B. Specifically, among the items listed in the separate sheet Nos. 7 in the separate sheet No. 1, the term “gresh washing machine” in the separate sheet may be deemed to fall under one of the two washing machines in the transfer contract.
