1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On September 30, 1910, attached Table 1 List “Real Estate List” on September 30, 1910, as shown in paragraph (1) (hereinafter “Land 1”).
(C) 1,370 square meters (4,529 square meters; hereinafter “the land before subdivision 1”) prior to the subdivision of the Gyeonggiwon-gun, which is the land before the subdivision.
(A) The “list of real estate” in the same Table means each of the lands listed in paragraphs 2 through 8 (hereinafter referred to as “lands 2 through 8”).
2) The Plaintiff’s land before the partition is divided into the Plaintiff’s land and the Plaintiff’s land before the partition is divided into the Plaintiff’s land at 21,048 square meters (69,580 square meters);
2) Each of the circumstances was examined. 2) The land before subdivision 1 and 2 was the land indicated in [Attachment 2] column of [Attachment 2] as shown in [Attachment 2] [Attachment 2] through the procedure of land substitution as indicated in [Attachment 2]. The land before subdivision was destroyed at the time of the incident.
B. The Plaintiff’s husband’s husband’s wife, E, F, and G were the family members of the Plaintiff’s husband’s husband’s husband, and F’s children were H, I, the Plaintiff, J, and K.
The above B, E, F, H, and I died on July 26, 1952, and the Plaintiff became the inheritor of Australia on the same day and inherited the above B’s property independently.
C. 1) The Defendant’s registration process of each of the instant lands is as follows: (a) each of the relevant entry in the column for “the details of ownership change” in the attached Table 1 sheet as to each of the instant lands on July 14, 1961 or May 12, 1983; and (b) each of the registration of ownership preservation (hereinafter “each of the instant preservation registrations”).
(2) The Korea Water Resources Corporation established an O development project since December 6, 1976, as the L construction plan was announced on October 2, 1976 and the urban planning decision (N in the Construction Division notification) was made on December 6, 1976.
3 Each of the instant lands was included in the project to create four sections for the housing complex of the O development project.
