A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
The Defendant was a person who worked as a manager at an entertainment tavern in the name of Seocho-gu Seoul Metropolitan Government “C”, and the victim D was a person who worked as an employee at the above main point, and the victim E was a person who worked as an employee at the above main point.
1. Around January 2011, the Defendant made a false statement with regard to the victim D, stating, “Around January 2011, the Defendant borrowed money to the victim and received interest from the other party, if he/she lends money to the other party, and one half of the interest that he/she received from the other party is given, and the principal will also be returned at the time.”
However, in fact, the defendant had no special property immediately after the release from prison at the time, and the amount of monthly income was limited to 1.5 million won, while the defendant was paid for the main place of business instead of his/her drinking value, and the monthly income was in short of living expenses, and only he/she was thought to be appropriated for the defendant's living expenses from the beginning, and there was no intention or ability to pay the principal to the victim with interest paid.
The Defendant, as such, deceiving the victim, received 18.10,000 won from the victim to the one bank account (G) in the name of F designated by the Defendant around the 25th of the same month, and from that time, received from the victim.
4. Until December 25, 2000, a total of 5,5910,000 won was remitted to the said account 16 times as shown in the annexed list of crimes.
2. Around July 2011, the criminal defendant against the victim E made a false statement to the victim of the said C entertainment tavern, stating, “The victim shall pay 200,000 won interest per day, including the principal, if he/she lends 10,000 won to the victim during his/her house, and shall pay 120,000 won per day for 100 days.”
However, the defendant is the victim for the same reasons as the above 1.
