A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Reasons
Punishment of the crime
The Defendant, as the actual operator of C Co., Ltd., the Defendant, on June 4, 2008, transferred the name of the corporation to C on October 2, 2008 and changed the name of the corporation to C on November 5, 2008 after changing the name of the corporation to C, as the actual operator of C, and entered into a check agreement with the Dong branch of Daegu Bank on June 4, 2008.
On November 10, 2008, E, which was the actual operator of D, has affixed the name cards of D in 10 copies per unit, provided by the above bank, and offered them to the defendant without stating the face value, issue date, etc.
Around November 2008, the Defendant issued a check number G check paper in the name of the C company in Daegu Jung-gu, stating “The Issuance Date, Dec. 6, 2008, and par value KRW 12,000,000,000” on the check number G check paper and presented a payment proposal on December 9, 2008, which is within the time limit for payment by the holder, but did not pay due to the shortage of deposits, and issued the check number G check paper in the name of the D company in attached Form No. 1 to 5, as shown in attached Form No. 5, including that the holder did not pay due to the shortage of deposits. However, the Defendant issued the check number G check paper in the name of the D company and presented it to pay the total face value of KRW 74,00,000,000 within the time limit for payment.
The Defendant, “2013rd 3066,” as a de facto operator of C Company, issued a check number check number check number at C Company’s office located in Daegu-gu, Daegu-gu, on November 16, 2008, stating “(15,000,000 won for a check number on February 20, 2009; hereinafter the same shall apply)” in the check number H check form, and issued a check number at the C Company’s office located in Daegu-gu, Daegu-gu, as indicated in the check number sheet (2), and presented a payment proposal on February 20, 2009, for which the holder had presented a payment proposal on February 20, 2009, but has not been paid upon the cancellation of the check contract, and as indicated in the check number sheet (2).
