1. The part of the Plaintiff’s lawsuit against the Defendant Republic of Korea demanding the existence of ownership shall be dismissed.
2. The plaintiff.
Reasons
1. Basic facts
A. The circumstance and circumstance of the land and the relation between the Defendants (i) K land at the time of the strike prior to the partition is land in the name of L, M, N,O, P land, Q, R land, land in Q, S land, C, U land, V land is land in the name of L, M, L, L, H, L W W, and X land in the name of L, M, and N.
(2) On December 7, 1995, Y succeeded to L’s property due to the death of L’s children. As Defendant B, C, E, F, G, H, and I died of Y’s children, Y’s property was jointly inherited.
B. The change of each land indicated in the separate sheet and the land indicated in paragraphs (1) and (2) of the attached Table Nos. 1 and (2) of the Defendants’ registered matters (A) were restored on August 1, 1961, respectively, and the land indicated in paragraph (2) of the attached Table No. 1 (hereinafter “No. 1”) and the land indicated in paragraph (2) of the same Table (hereinafter “No. 2 land”) following the change of administrative district name on March 1, 196.
(B) On March 27, 1995, Defendant Republic of Korea completed the registration of ownership holder in its name through the procedures for public notice of non-owned real estate on the land Nos. 1 and 2, and the registration of ownership preservation in its name on October 13, 1995.
(2) The P land listed in [Attachment List 3 and 4 (A) is the land listed in [Attachment List 3 and 3 (hereinafter “third land”) and the land listed in Attached Table 4 (hereinafter “No. 4”) was divided into the land of AB and AC, and the land of AC was converted into the land of August 1, 196, the cadastral restoration on July 10, 196, the land category change on which July 10, 197, the conversion of AB into the square meter on December 1, 1978, and the change of administrative district name on March 1, 196, and the land of AC was the land listed in Attached Table 4 (hereinafter “No. 4”).
(B) Defendant B completed the registration of initial ownership in his name on the land Nos. 3 and 4 of February 17, 1965.
(3) The land (A) indicated in paragraph (5) of the annexed Table No. 5 of the Q Q land was registered on August 1, 1961; the conversion registration on December 1, 1978 into two parallels; and the land listed in paragraph (5) of the annexed Table No. 5 (hereinafter referred to as “land No. 5”) after the change of the name of the administrative district on March 1, 196.
