A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On November 22, 2010, the Defendant was sentenced to five years of imprisonment with prison labor due to intrusion larceny at night at the Busan District Court on November 22, 201, and on December 29, 2017, the Defendant completed the execution of the sentence at a smuggling detention house.

1. On August 9, 2018, at around 03:00, the Defendant discovered that the victim E was drunk in front of the “D Singing practice hall” located in Busan Northern-gu, Busan, and act as if he had access to the victim and found the victim’s things, the Defendant stolen the victim’s cash amounting to KRW 80,000, driving license, new driver’s license, and Busan FFC card, the Nong C C C C CC card, and the Busan Bank BC card, one by hand, and cut off the victim’s 60,000,000,000,000,000,000,000.

2. The Defendant violated the Act on Financial Business Specializing in Fraud and Credit Business: (a) around 04:58 on the same day as indicated in paragraph (1) of this Article; (b) as if the Defendant had been holding a legitimate right to use the Plaintiff’s name in the “G Singing shop” operated by the Defendant, the Defendant was provided with alcohol and services equivalent to KRW 90,000 from the damaged party; and (c) by settling the said amount with the stolen credit card, the Defendant illegally used the credit card by paying it with the stolen credit card; and (d) as described in the list of crimes in the attached Table of Crimes, the Defendant was provided property or financial benefits equivalent to KRW 1,352,200 on a total amount of 14 occasions from around the same day to 11:15 on the same day. Such credit card was unlawfully used.
