A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On April 28, 2018, the Defendant acquired property owned by the victims four times from around 05:00 to around 05:00, following the “C” located in Seo-gu, Daegu-gu, Seo-gu, (hereinafter “C”), including acquiring a card (credit number: F) of the Public Official Pension Service, which is the victim owned by the victim D, and around that time, during the period from September 2018, the Defendant acquired property owned by the victims four times as shown in attached Table 1.
The defendant did not follow necessary procedures such as returning the acquired property to the victims as above and embezzled the property that he had on his own mind and has left the possession of the victims.
2. On August 23, 2018, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit, within the “I convenience store” operated by the victim H in Daegu-gu, Daegu-gu, without any intent or ability to pay the price, as if he/she had an objection to a legitimate right to use by either purchasing and paying the price. As such, the Defendant, as stated in the above paragraph (1), presented the J Bank Postal Card (Credit Card (Credit Card Number) obtained on August 23, 2018, and made the payment to himself/herself at around 03:00 on August 23, 2018, was at least 48,000 won in the market price from the injured party, using the lost debit card that was provided with 1 Bod tobacco 1 Bodon and lost, from around that time to September 30, 2018, provided that he/she did not have an intent or ability to use a debit card with a legitimate intent to use, or presented it to him/her, as if he/she had a debit card.
3. On September 30, 2018, the Defendant discovered that the Victim L was under influence of alcohol in front of the “C” located in Daegu Seo-gu, Seo-gu, Seo-gu, on September 30, 2018, and accessed it to that person, and contains S7 mobile phones and M bank cards (credit number N) equivalent to KRW 800,000 at the market price located adjacent to the victim’s head.
