Reasons
Punishment of the crime
1. From August 1, 2007 to February 28, 2009, Defendant A’s occupational embezzlement is a director of the “FFFFFFF H branch” located in Gangseo-gu Seoul Metropolitan Government E, and has overall control over the accounting and fund management of the “FFFFFF H branch,” and a person engaged in the business of collecting and selling the free seeds of a high troke troke troup and paying the settlement amount.
At around September 20, 2008, the Defendant: (a) harvested from the Defendant’s high-speed cream site cultivated by the Victim I to pay the settlement amount thereof; (b) sold from September 20, 2008 to September 22, 2008, a sum of KRW 17,474,000 from the victim’s non-dry field amounting to KRW 17,386,320, which was harvested from around 4,00 to from September 22, 2008, and then sold to the K “L” for the operation of the K. On October 30, 2008, the Defendant settled the amount calculated by deducting KRW 12,087,680, such as personnel expenses, packing expenses, etc. incurred in the process of harvesting and selling the said non-dry from around 30, 208.
On September 20, 2008, the above “L” delivered KRW 40 million to the person in charge of the FFFF H branch (“the State”). On October 30, 2008, the Defendant embezzled KRW 1,498,394 from the person in charge of the FF H branch (“the Defendant”) to the agricultural bank account under the name of M in the name of the head of the Working Group in the Defendant’s office. On November 11, 2008, the Defendant was transferred KRW 3,88,00 for the said account and stored for the victim. On October 31, 2008, the Defendant arbitrarily used the above KRW 1,498,394 for the purpose of the Defendant’s office’s operating expenses, etc., and embezzled KRW 38,80,000 for the above purpose on November 13, 2008.
2. On June 12, 2008, the Defendants’ act of forging private documents and uttering of falsified investigation documents shall be paid KRW 50 million in advance to N in the form of contract deposit at the FFF H branch, “FFH branch,” and “FFFFFF H branch,” with the condition that the Defendants shipping the troke troke that farmers N are cultivated in the dry field located in Yangyang-gu, Gangwon-gu, Yangwon-gun to FFFF branch,” and the Defendants shall pay KRW 50 million in advance to N in the form of contract deposit.
