1. The Defendants deliver to the Plaintiff the building indicated in the attached real estate description.
2. The costs of lawsuit are assessed against the Defendants.
Reasons
1. Determination as to the cause of claim
A. The Plaintiff operated the National Housing Fund from July 28, 1981 to 1986 to ensure the residential stability of citizens and to resolve the housing shortage of homeless residents. 2) On July 28, 1981, the Plaintiff obtained project approval from the Gangwon-do Governor of Gangwon-do to build the 20 household national housing (hereinafter “the instant national housing project”) on the land outside C and 2 lots in the East Sea (hereinafter “the instant project”).
3) On June 16, 1981, the Plaintiff, as the project undertaker (project executor) and contractor, appointed E as the contractor, and E recruited its members to move into the national housing of this case in the capacity of the Convention, up to August 30, 1981, and bears the responsibility for the construction work of the instant national housing. 4) E followed followed only the framework construction work of the instant national housing, and E, including F, who was subcontracted for Shasi, went into bankruptcy, finished the construction work of the instant national housing.
5) From December 1, 1982 after completing shower construction subcontracted by E, F means the building indicated in the attached real estate among the national housing of this case (hereinafter “instant building”).
(6) Since around 2008, the Plaintiff had consulted with interested parties, such as the tenants of the instant national housing for the recovery of the National Housing Fund. Around 2009, the Plaintiff had reduced the annual amount of the National Housing Fund and had the F transferred all rights to the instant building from F.
7) The Plaintiff registered as the owner of the instant building on August 18, 2010 on the aggregate building ledger on the ground that he/she was a project operator or contractor, and as the Dongcheon District Court’s East Sea Office received on September 15, 2010 on the instant building as the owner.
