1. The Defendant’s KRW 175,00,000 for the Plaintiff and 5% per annum from August 22, 2017 to December 12, 2018.
Reasons
1. Basic facts
A. On October 8, 2014, with the Defendant, the Plaintiff entered into a basic and working design service contract (hereinafter “instant design service contract”) with the content that the Plaintiff shall comply with the date of commencement on October 8, 2014; June 4, 2015; the date of completion on June 4, 2015; and the date of completion on July 4, 2015; and submit the basic and working design drawings, etc. to the Defendant; and the Defendant shall pay the Plaintiff KRW 1.418 billion to the Plaintiff.
Since then, the Plaintiff prepared a variety of design drawings, etc. according to the instant design service contract and provided them to the Defendant, and the Defendant paid the full amount of the service cost to the Plaintiff.
B. The purpose of the instant project is to change five tanks installed in the facilities located in Seoul B, Seoul, into a place for public performance and exhibition, and to create a complex ecological and cultural space by newly constructing a building and support facilities in the DTank shape, etc. On December 21, 2015, the Defendant entered into the instant construction contract with the Plaintiff’s Intervenor (which was called “Co., Ltd.’s text loan, but was changed to its trade name as of March 5, 2018; hereinafter “the Intervenor”) that constituted a joint contractor on March 5, 2018; the Intervenor and the Geumcheondong Industry (hereinafter “CC”), etc. on December 30, 2015, the date of its commencement; the date of its completion; the date of its completion; the date of its construction completion; the construction project; and the construction project cost of the instant construction project; and the construction project cost of the instant construction project to be paid to the Intervenor and the Intervenor under the terms and conditions of the construction contract; and the construction project cost of the instant construction project.
