1. Defendant D Co., Ltd.: (a) KRW 21,400,000 for the Plaintiff and the period from October 7, 2015 to November 10, 2016.

Reasons

1. Facts of recognition;

A. Defendant B was the owner of 1,309.8 square meters in Sinju, E, and F was the owner of the GJ site adjacent to Defendant B’s above site, and F was the owner of the building with three square meters adjacent to Defendant B’s above site, and the housing accommodation facilities (hereinafter “Plaintiff’s real estate”).

B. On September 19, 2014, Defendant B entered into a contract with Defendant D Co., Ltd. (hereinafter “Defendant D”) for construction works with respect to H “H” on the ground of the instant site (hereinafter “instant construction works”), and on September 29, 2014, Defendant D designated Defendant D as the contractor of the instant construction works and filed a report on the commencement of construction works with Defendant D as the contractor of the instant construction works.

On October 1, 2014, the official housing market issued a report completion certificate on the commencement of the construction project to Defendant B, and Defendant D performed the instant construction project from that time.

C. On November 28, 2014, the Plaintiff purchased the instant real estate from F, and completed the registration of ownership transfer on the instant real estate on December 18, 2014.

Defendant C purchased the instant site from Defendant B on April 1, 2015, and completed the registration of ownership transfer on the said site on May 6, 2015.

Accordingly, on May 6, 2015, Defendant C changed the owner of the instant construction from Defendant B to Defendant C from May 6, 2015, and Defendant C issued the certificate of change of construction participants under the said report to Defendant C on May 8, 2015.

E. Meanwhile, as the construction of the instant land was conducted in bad faith in the course of the process of the construction, and the management before and after the construction took place bad faith, the safety issues arise in the part of the site due to ground subsidence and the completion of the instant real estate adjoining the instant Plaintiff’s land. Of the instant Plaintiff’s real estate, the parts regarding the reduction of the establishment and implementation of steel stairs and lumber among the instant real estate were destroyed, using the said stairs.
