A defendant shall be punished by imprisonment for not less than three months.

Punishment of the crime

[2013dan246] On December 14, 2012, the Defendant: (a) committed theft by hiding in the display stand, the market price of which is equivalent to KRW 19,200,00, the victim’s property owned by the Defendant, located in the display stand by taking advantage of the gaps of surveillance in the Eart of the victim’s D operation in Suwon-gu Suwon-gu Suwon-si, Suwon-si, Suwon-si, Suwon-si; and (b) was stolen.

[2013No. 362] On January 28, 2013, the Defendant, at the “H” convenience store operated by the victim G located in Suwon-si F, Suwon-si, which was located in the display stand, placed in the display stand of the victim’s attention. At around 16:20 on January 28, 2013, the Defendant placed one of the face-to-face 23,00 won of the market price of the victim’s possession in the display stand, into the right road of the Defendant, and stolen it.

Among concurrent offenders, the reason for sentencing under the former part of Article 37, Article 38(1)2, and Article 50 of the Criminal Act has the ability to punish multiple victims for the same kind of crime, and the crime of this case is continuously committed during the period of probation accompanied by probation for the same kind of crime, and even before the case, the sentence of imprisonment cannot be avoided even if the amount of damage caused by the crime of this case has been restored to some victims as a small amount of damage.

However, the punishment shall be determined in consideration of the fact that the accused has yet to be aged, and that the accused recognizes his criminal act and repents it (competences).

It is so decided as per Disposition for the above reasons.
