Reasons
1. Basic facts
A. With respect to the land listed in the ownership registration status, each land listed in the separate sheet for inheritance due to the death of C (hereinafter “each land of this case”), among the land listed in paragraph (1), for example, for each of the land listed in paragraph (1), 1/3 shares in the name of the Plaintiff clan, C, DefendantO, 2/3 shares in relation to the land, 1/3 shares in the name of the Plaintiff clan, 3/4 shares in the name of the Plaintiff clan for the land listed in subparagraphs 2 through 8, 10 shares in the name of the Defendant clan, 1/4 shares in the name of the Plaintiff clan for the land listed in paragraph (1), 1/11 through 19 shares in the name of the Defendant clan, 3/4 shares in the name of the Plaintiff clan, 1/3 shares in the name of
However, as the Defendant C died on September 18, 2014 during the instant lawsuit, on the part of the deceased, Defendant D, the wife of the deceased, and Defendant E, F, G, H, I, and J, each of 4/34 shares of the deceased’s 4/34 shares, and Defendant K, L, M, M, and N, each of 1/34 shares of the deceased’s her son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son’s son
B. As to the land No. 1 of 1, the circumstances and the process of changing ownership registration, after S was assessed on September 25, 1917, on March 13, 1935, T’s registration of ownership was completed on March 13, 1935, the registration of ownership transfer was completed by U, and W on December 30, 196, respectively. On August 17, 1970, X, C, and Q, which were put by DefendantO, was repealed by Act No. 211, Dec. 19, 208; hereinafter “Special Measures Act”).
A) Pursuant to the registration of ownership transfer was completed. X died on October 11, 1976, and its inheritor had the DefendantO, Z, AAB, AB, and AC, the wife and children. On March 21, 2008, the DefendantO completed the registration of ownership transfer for one-third share of the X’s own name among the land No. 1 on April 30, 2008, for inheritance by agreement and division. On the other hand, Q has completed the registration of ownership transfer for one-third share of one-third share of his own name among the land No. 1 on April 30, 2008 (hereinafter “AD”).
The registration of ownership transfer was completed on June 5, 2012.
