1. The Defendants are jointly and severally liable to Plaintiff B for KRW 11,50,000, and KRW 10,000,000 to Plaintiff C, and the aforementioned amount.
Reasons
1. Factual basis
A. The Defendants: (a) operate an automobile purchasing agency with the trade name of F as joint business operators; and (b) establish and operate a stock company F; (c) concluded that “If two joint buyers are subscribed to 17.5 million won as joint purchase price and two recommended subscribers are joined again and a team is organized with a total of seven members, they would purchase high-class bents vehicles with a total of 68 million won or pay 58 million won in cash after completing the joint purchase program; (d) the Defendants recruited joint buyers and received investment money. The Defendants did not have an official with the supply of bent vehicles. The above car purchasing program was conducted in the first, second and fourth stages, and three stages, and the number of subscribers should continue to exist two times as joint purchase price; (e) the vehicle was able to purchase the vehicle; and (e) there was no choice but to receive any new investment from the investors, or any existing investment project was made in the way that the said investors would not be able to receive any new cash redemption from the investors.
The Defendants were sentenced to the judgment of the first instance court in Busan District Court 2016Kadan598 and 2016Kadan1067 due to the violation of the Act on the Regulation of Fraud and the Act on the Regulation of Conducting Fund-Raising Business, and the two cases were merged in the appellate court, and the Defendant D was sentenced to imprisonment for four years, and Defendant E was sentenced to imprisonment for two years, and the sentence was finalized
