1. The plaintiff (Counterclaim defendant) is jointly involved with the real estate stated in the separate sheet from the defendant (Counterclaim plaintiff).
Reasons
1. Basic facts
A. The parties concerned are companies engaged in the business of constructing and selling commercial buildings and officetels, and the plaintiffs are several buyers who concluded a sales contract with the defendant for the real estate listed in the separate sheet (hereinafter “instant store”).
B. The Plaintiffs, including the conclusion of the sales contract, are married couple. On May 2, 2016, the Plaintiffs concluded a sales contract with the Defendant for the instant store as indicated below (hereinafter “instant sales contract”).
A) A contract for supply of goods was entered into. C: The seller’s late payment on June 29, 2016, the first intermediate payment of KRW 29,509,128,28 won and the second intermediate payment of KRW 206,50,500,000,000 and KRW 66.00,000 and KRW 92.95,000,000,000 shares in the contract for the area for exclusive use by the exclusive use of the building of KRW 301,00,000 and KRW 278,38,388,000,000; and the amount of land to be paid at the time of the annual payment; and the amount to be paid at the time when the buyer entered into a contract for the down payment of value-added tax; and ① the buyer’s late payment penalty shall not be paid at the late payment rate of KRW 206,509,128,28,016.
When he/she fails to pay the heavy or remaining amount within one month from the date of the agreement;
(b) Where the real transfer, lease, establishment of security, limited real right, etc. has been established without approval of the seller before the balance is paid;
(c) Where he/she fails to open a designated daily store or open a designated store without reasonable grounds;
D. When the above store shape of the commercial building is modified without a seller's approval and it is likely to hinder the operation of the commercial building. (3) This contract will be cancelled due to the reasons falling under paragraph (1) of this Article or due to the buyer.
