A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2013 Highest 684] The Defendant, without permission of C, stated C as if C permitted joint and several sureties to receive a loan from the lending company without permission, on the basis that he/she keeps the certificate of the personal seal impression of friendly C.
1. Around February 1, 2012, the Defendant: (a) requested that the Defendant be granted a loan by telephone from an employee of an insolvent lending company under Section B 301 of the D D Building B; and (b) requested that the Defendant be granted a loan; (c) loan transaction contract to be a creditor of a loan company to be a loan company; (d) loan transaction contract to be a creditor of a loan company to be a loan company; and (d) under the loan transaction contract to be a creditor of the Dong-do-U.S.-U.S.-U.S. deposit bank; and (e) under the loan transaction contract to be entered into with the creditor of the Dong-U.S. deposit bank as the creditor, the Defendant entered the amount of each loan in the column as “A, the 300,000 or 300,000,000” in the column of the loan amount as “A, the 300,000,000 won,” and the date of the contract as “Seoul apartment Co., Ltd. 1, 201 and Da.
Accordingly, the defendant, for the purpose of use, forged four loan transaction contracts with C as joint and several sureties without authority.
2. On February 3, 2012, the Defendant: (a) requested an employee of the said insolvent lending company to grant a loan, who is aware of the forgery, four of the lending contract form in the name of C, at an unsound place; and (b) sent the relevant investigating document by mail.
3. Around February 3, 2012, the Defendant filed an application for a loan of KRW 15 million in total with five million with respect to each of five members, including the victim temean Korea, the victim large-scale loan company, the victim Dong-do loan company, the victim victim corporation corporation, the loan capital, and the victim Yunion Savings Bank, through employees of the non-performing loan company, and filed an application for a loan of KRW 15 million with the said joint and several sureties.
