1. 피고인 A, 피고인 B의 공동범행 피고인 A은 2017. 11. 19. 22:00경 전남 완도군 D 소재 'E' 식당 앞에서 친구인 피해자 C(34세)과 과거 서운한 점에 관하여 이야기를 나누다가 시비가 붙어 피해자의 멱살을 잡고 주먹으로 얼굴부위를 수 회 때리고, 피고인 A의 형인 피고인 B는 현장에 있던 지인의 연락을 받고 위 식당 앞에 찾아와 피고인 A이 제2항과 같이 피해자에게 폭행을 당해 쓰러져 있는 것을 보고 화가 나 주먹으로 피해자의 얼굴을 수회 때리고 복부를 수 회 걷어차고, 계속하여 피고인 A은 정신을 차리고 일어나 피고인 B가 피해자를 때리는 것을 보고 이에 합세하여 발로 피해자의 복부를 수 회 걷어찼다.
