Reasons
Punishment of the crime
On May 21, 2012, the Defendants entered the Republic of Korea into the non-professional employees visa (E-9) status on May 21, 2012, and were working for E (State) located in No. 4306 at Sin interest. On February 2, 2013, the Defendants performed alcohol with the victim F(34 years of age) in the secondary container dormitory of the above E (State) around February 23, 2013.
1. Around February 23, 2013, Defendant A’s violation of the Punishment of Violence, etc. Act (a collective, deadly weapons, etc.) committed intimidation on the part of the victim on the ground that: (a) the victim’s 2nd floor container of the above E (State) stolen alcohol by the Defendant, and scambling the alcohol from the dormitory of the second floor of the E (State) on the ground that “I am scambling about how I am scams would have stolen the alcohol; and (b) the victim’s knick (Evidence No. 1) was scambling on the part of the victim, thereby threatening the victim.”
2. Joint crimes committed by the Defendants
A. On February 3, 2013, at around 06:29, the Defendants: (a) told the victim, who was satisfing from the above E (State) container dormitory, that he saw the Defendants to live in a dub and have disputes with each other; (b) he saw the victim as “patfing so that it would not interfere with it due to the collapse”; and (c) the victim, who was getting out of stairs to return home, did so so so so so by the Defendant A, even so far from the entrance of the second floor container container to the concrete floor of 2.3 meters away from the floor of the first floor.
The Defendants reported the victims who continued to drink alcohol while leaving the victims neglected in the above state at around 06:48 on the same day, and used the body of the victims, such as their head, chest, arms, and legs, at least 10 times, and forced the victims to leave the beer within the victim's entrance, but the victims again refused to move.
