1. Basic facts

A. The Plaintiff is a company established for the purpose of carrying on shipbuilding business, etc., and the Defendant is a corporation established based on the Act on the Indemnification for Fire-Caused Loss and the Purchase of Insurance Policies, which aims at governmental agencies and defense industry-related insurance business.

B. On June 13, 2012, the Plaintiff entered into a shipbuilding contract with the Defense Acquisition Program Administration under the Ministry of National Defense for three subsequent boxes (16, 17, and 18 boxes).

C. Among the equipment installed by the Plaintiff in the said vessel, there are equipment installed by the Plaintiff after being provided by the Defense Acquisition Program Administration (hereinafter “government-funded equipment”). On June 13, 2013, the Plaintiff and the Defendant entered into an assembly insurance contract with the Defendant as the insurer in relation to the assembly of government-funded equipment, and the Plaintiff and the Defense Acquisition Program Administration as the insured (hereinafter “instant insurance contract”). The main contents of the instant insurance contract are as follows.
