Reasons
1. The claim against the defendant corporation on the family;
A. A. The occurrence of liability for damages (1) is recognized by the network E (hereinafter “the deceased”) is a person who has engaged in a prefabricated construction business in the name of “F” from November 18, 201 to “F.”
(B) On July 25, 2014, Defendant A Co., Ltd. (hereinafter “Defendant A”) employed the Deceased as a part of the G Corporation (the construction period: from May 14, 2014 to December 30, 2014; hereinafter “instant construction”).
(C) On July 25, 2014, around 10:30 on July 25, 2014, the Deceased lost his body center and fell on the ground while performing the construction work of cutting off (Purlin and C-type) from upper part of the roof penter (11m high) of the steel roof roof (hereinafter “instant accident”) (hereinafter “instant accident”), and the safety facilities, such as the safety net, were not installed at the time, and the Deceased worn a safety cap.
(D) immediately after the instant accident, the Deceased transferred to a nearby hospital, but died on July 31, 2014 due to a multi-presidential organ, etc.
(E) Plaintiff A’s wife, Plaintiff B’s father, and Plaintiff C’s mother.
【In light of the above-mentioned facts without any dispute, Gap evidence Nos. 1 through 7, 9, and 11 (including a branch number) and the whole purport of the pleadings, the above-mentioned facts of recognition are as follows: The defendant A, as the user of the deceased, violated the safety facilities for the prevention of fall; thus, the deceased and the plaintiffs are liable to compensate for damages caused by the accident of this case.
B. The limitation of liability for damages: (a) the steel roof camera, which is a point where the deceased falls down, is narrow at 200m width; (b) the C-Bar C-Bar Clip protruding at intervals of 1,100m; and (c) the deceased was aware of it in advance; (b) thus, the deceased should bear care in moving and operating on the steel roof roof camera, thereby preventing danger by itself.
