1. The defendant's KRW 40,000,00 for the plaintiffs and 5% per annum from May 17, 2020 to September 8, 2020, respectively.
Reasons
1. Basic facts
A. 1) Real estate listed in the separate sheet in which the Defendant owned (hereinafter “instant real estate”) as to the real estate owned by the Defendant
A) On December 27, 2019, the power of attorney was drawn up under the Defendant’s name, which delegated all the powers pertaining to the sale and purchase and lease of real estate to D. (2) D entrusted real estate sales brokerage to the real estate brokerage office (hereinafter “E real estate”) called “E”, and E real estate requested brokerage to the real estate brokerage office, “F real estate” and “G”.
B. The plaintiffs paid 10,00,000 won for the purchase of the instant real estate through F-real estate; 80,000,000 won for the purchase of the instant real estate; 200,000 won for intermediate payment; 520,000,000 won for the remainder payment ( March 23); and 10,000,000 won for the remainder payment ( March 23), and part of the down payment of 10,000,000 won for the purchase of the instant real estate; 20,000,000 won for the purchase of the instant real estate through F-real estate; 3:0,000,000 won for the purchase of the instant real estate; and 3:1,00,000,0000 won for the buyer to whom part of the down payment was made; and 2:3:1,200,0000,000 won for the remainder payment after the payment of the down payment was made.
3) Around 18:34 on January 10, 2020, F real estate delivered the following letters from E-real estate to the Plaintiffs. The sale amount under the H sale contract condition of Dongdaemun-gu Seoul Metropolitan Government: 80 million won; the date of the contract: the consultation made within January 14; the down payment: 80 million won; the intermediate payment; 200 million won (20 million won on February 12); and the remainder: 520 million won (part of the total down payment of 80 million won on March 23; the deposit of 10 million won on January 10, 202; and the contract is concluded at the time of partial deposit of the down payment prior to the contract deposit.
When the parties fail to comply with the contract, penalty.
