A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

피고인은 2018. 11. 19. 17:00경 광주 서구 B에 있는 C 카페에서 직장동료의 친구 소개로 청각장애 2급, 지적장애 2급의 장애인인 피해자 D(가명, 여, 27세)을 처음 보게 되었고, 피해자 및 일행들과 함께 저녁을 먹기 위해 식당으로 걸어가던 중 갑자기 피해자의 어깨에 팔을 올리며 어깨동무를 하여, 이에 피해자가 피고인의 손을 뿌리치면서 불쾌감을 표시하였음에도, 광주 서구 E에 있는 F 식당에 도착하여 피고인 옆에 있던 피해자에게 자리에 앉으라고 하면서 피해자의 왼쪽 가슴 윗 부위를 누르고, 식사를 하다가 입술로 뽀뽀하는 시늉을 하고 피해자의 손을 주물럭 거리듯 만져 피해자를 강제추행하였다.
