A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. On July 4, 2015, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents, the Violation of Road Traffic Act (drinking driving), and the Road Traffic Act: (a) while under the influence of alcohol content of 0.091% among blood transfusions, C ambrodo driven a car with a view to 0.091% of alcohol content; (b) led the Defendant to drive a car on the front side of the E station located in Gangwon-do, which is located in Gangwon-do.
At the same time, the road is bended by a bend line with the center line of the yellow-ray. In such a case, there was a duty of care to thoroughly drive the person engaged in driving service with the front line and to safely drive the vehicle.
Nevertheless, under the influence of alcohol, the Defendant was negligent in driving the center line with the driver’s negligence, and the victim F (71 Do) was driven in the opposite direction by the driver’s F (71 Do). However, the Defendant was driven in the front part of the left-hand part of the car driving by the Defendant.
As a result, the Defendant suffered injury to the victim, such as chest feling, which requires approximately six weeks of treatment by occupational negligence as above, and at the same time damaged vehicles to the extent that the repair cost is approximately KRW 18,524,550.
2. The Defendant, in violation of the Guarantee of Automobile Compensation for Damages, is the owner of a motor vehicle.
No owner of any motor vehicle shall operate any motor vehicle on a road which is not covered by mandatory insurance.
Nevertheless, the Defendant:
(a) On June 23, 2015, 04:36, on the road at one km of the I resting area located in Hongcheon-gun, Hongcheon-gun, G:
B. On June 25, 2015, 18:32 at the front of K, located in the Hongcheon-gun of Hongcheon-gun:
C. On July 4, 2015, around 19:40, on the roads front of the E gas station located in Gangwon-gun D, the above co-section, which was not covered by each mandatory insurance, operated an automobile.
