A defendant shall be punished by imprisonment for five years.

The defendant shall be ordered to complete the sexual assault treatment program for 40 hours.

Punishment of the crime

The Defendant has maintained the relationship between the victim B (a life, female, 31 years of age) and the victim B (a life, female, 31 years of age) from October 2017 to September 2018.

1. Violation of the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (Kameras and photographing);

A. On July 25, 2018, around 01:52, the Defendant posted the Defendant’s mobile phone image shooting function at the hotel room in the non-resident room in Jung-gu Seoul Metropolitan Government, Jung-gu, Seoul, without the victim’s consent, and taken a video image of the Defendant’s sexual intercourse with the victim.

B. On July 28, 2018, around 21:41, the Defendant: (a) placed the Defendant’s mobile phone photographing function in the hotel room in Goyang-si, Gyeonggi-do, without the victim’s consent; and (b) taken the screen image of the Defendant’s sexual intercourse with the victim, without the victim’s consent.

C. On September 20, 2018, the Defendant installed in the hotel room with the victim’s mobile phone without the victim’s consent, in a non-permanent hotel room on September 15:24, 2018, the Defendant taken a video screen with the victim’s sexual intercourse.

Accordingly, the defendant taken the body of the victim against his will that could cause sexual humiliations or shames using mobile phones over three times.

2. Before October 7, 2018, the Defendant, on the grounds that another male and the victim were present at the mother's residence of Seongdong-gu Seoul Metropolitan Government E apartment and Fho Lake, the Defendant sent the victim a photograph taken by the Defendant and the victim to his mobile phone G dialogue with the victim, and sent the victim a message "I am her husband", "I am her husband", "I am am her husband", "I am am in the south of Korea", "I am in the south of Korea, I am," and "I am ambling with the victim to the effect that I am her husband will know of the internal relationship between the Defendant and the victim, as shown in the list of crimes committed in the attached Table from around that time to October 15, 2018.
