1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The following facts do not conflict between the parties, or may be acknowledged by taking account of the whole purport of the pleadings as a whole in each of the statements in Gap evidence 1-1, 2, 2-2, 3-3, 4-5, 5-1 through 10, 7, and 8-1 through 8.
On December 23, 1910, Nonparty J was found to have been in the situation of 11,683 square meters of K forest in the Dong-gu, Daegu-gu, Daegu-gu (hereinafter “instant land”).
B. On January 16, 1992, the deceased J’s deceased L (Death on May 5, 1992) obtained a judgment of the Daegu District Court rendered on January 16, 1992 against the Republic of Korea on the confirmation of ownership of the forest before the instant subdivision, and completed the registration of ownership preservation in its name on February 28, 1992.
C. On April 20, 1992, the deceased L sold in KRW 150,00,00 the forest land before the instant partition to Defendant I, C, and B, and on April 28, 1992, the registration of ownership transfer was completed to the above Defendants. On the other hand, on May 26, 192, Defendant I, C, and B divided the forest land before the instant partition into eight parcels, such as the attached real estate list, and completed each registration of ownership transfer as the cause of partition of co-owned property on May 27, 192.
Afterward, the Daegu District Court, Daegu District Court, Daegu District Court, No. 39305, May 27, 1992, as to each real estate listed in the separate sheet on the ground of sale, partition of co-owned property, termination of title trust, successful bid, etc., and finally, on the real estate listed in the separate sheet, the registration of transfer of ownership in the name of Defendant B as to the real estate listed in the separate sheet No. 39394, May 27, 1992; as to the real estate listed in the separate sheet No. 3. 3.4820, Jun. 1, 1993; as to the registration of transfer of ownership in the name of each Defendant C as to the real estate listed in the separate sheet No. 826, May 5, 1996; as to the registration of transfer of ownership in the name of Defendant D as to the real estate listed in the separate sheet No. 8293, Jan. 29, 1996; as to the registration office No. 1314.194.134.
