Punishment of the crime

[criminal history] Defendant B was sentenced to two years of imprisonment for a similar rape in the Seoul Eastern District Court on July 24, 2014, and the execution of the above sentence was terminated on July 22, 2015. On September 30, 2016, Defendant B was sentenced to one year and four months of imprisonment for a violation of the Narcotics Control Act at the Incheon District Court on September 30, 2016, and the judgment became final and conclusive on May 26, 2017.

[Criminal facts]

1. Despite the fact that the Defendants were not narcotics handlers, the Defendants conspired to sell and sell Metetop clops (the “copon”; hereinafter referred to as the “philopon”), which is a local mental medicine, on two occasions as follows.

The Defendants, as a person in a de facto marital relationship, instructed Defendant A, who was confined to the Incheon detention center, to “scopon sales of phiphones to persons in need of philophones”, the Defendants recruited Defendant A to sell philophones according to their instructions.

1. Macking the wife;

“The Defendant A, who completed the interview with F, told the F to the effect that “The F would have asked to do so, and the F would have attempted to use the goods (referring to a philopon).”

Since then, according to the above orders of Defendant A, Defendant A sold phiphones to F twice as follows.

A. On November 22, 2016, at around 23:00, Defendant A purchased the volume of philopon from I to 300,000 won in the Hamop parking lot near the Hemopon located in Dongdaemun-gu Seoul Metropolitan Government, and on the same day, Defendant A sold F the volume of philopon to F at the same place on the same 23:40 day.

B. Defendant A, at around December 29, 2016, 21:00, i.e., hamphones from I.
