A defendant shall be punished by imprisonment for two years.

Punishment of the crime

The Defendant is a person who is engaged in driving of Bone Star Co., Ltd.

1. On September 25, 2017, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) driven the said vehicle while under the influence of alcohol level of 0.211% on blood alcohol level on September 25, 2017, and led the said vehicle to proceed with the road of 1101 lanes in front of the 1101 foot-gu, Seoan-gu, Seoan City.

A driver of a motor vehicle has a duty of care to safely drive the motor vehicle by accurately operating the steering direction and brake system.

Nevertheless, the Defendant was negligent in driving under the influence of drinking so as to lead the center line by neglecting it while driving normally due to the influence of drinking, and was driven by the victim C (the age of 36) who was under normal driving in the opposite part, as the front part of the Defendant’s vehicle.

Ultimately, the Defendant suffered injury to the victim, such as the left-hand sulverization of 12 weeks of treatment due to the above occupational negligence.

2. On May 22, 2008, the Defendant was sentenced to a suspended sentence of six months by imprisonment with labor for a violation of the Road Traffic Act (driving under the influence of alcohol) at the Suwon District Court on May 2, 2008, and on July 9, 2012, the Defendant was issued a summary order of three million won by a fine for a violation of the Road Traffic Act (driving under the influence of alcohol) at the Seowon District Court.
