A defendant shall be punished by imprisonment for one year.

Punishment of the crime

1. The Defendant, around the first half of August 2012, 201, told the victim D to “if a futures option investment is made, the daily amount of profit would be 5 to 10 times the amount of profit per day. A few times the amount of money that is 15 million won or more, the principal would be paid immediately within 15 days, and the interest would be paid to the amount of money and USD.”

However, even if the defendant borrowed money from the victim, he did not have the intent or ability to pay the principal or interest.

On September 3, 2012, the Defendant received 7 million won in total from the victim to the new financial investment account (Account Number:F) in the name of Defendant Dong-dong E, which was designated by the Defendant on September 3, 2012. On September 5, 2012, the Defendant received KRW 15 million in total from the said E account under the same name on September 5, 2012.

2. The Defendant, around the first half of September 2012, at a cultural center located in Mapo-gu Seoul Metropolitan City, told the victim to live a large amount of money that would be raised up to KRW 100 million. The principal would be repaid up until December 15, 2012, and KRW 500,000 per month will be paid for living expenses, and the real estate office will also be sought in Mapo-gu, and if a church is set up to a church, it would be entirely responsible for the management of the victim.”

However, even if the defendant borrowed money from the victim, the defendant did not have the intent or ability to pay the principal or living expenses.

On September 11, 2012, the Defendant received 60 million won from the victim to the above E account under the name of the said E as a loan.

Accordingly, the defendant was given money by deceiving the victim.
