A defendant shall be punished by imprisonment for one year.

Punishment of the crime

The Defendant worked at the “D” mobile phone sales store operated by the victim C in Gunsan-si, and opened a mobile phone service under the name of another person using the customer’s personal information, etc. stored therein, and tried to steal and dispose of such mobile phone.

1. Around May 25, 2015, the Defendant had access to “F”, which is an E mobile phone opening system, using an ID, at the foregoing “D” office. Around February 22, 2015, entered the name, resident registration number, address, etc. in the foregoing office with a copy of G’s identification card stored in the foregoing office, and then forged one file of G’s mobile phone subscription application form, stating that it is “G” in the terms and conditions column. Around that time, the Defendant then sent “F” to the E employee in charge of the said fact through the Internet as if it was duly formed. Around February 22, 2015, from around October 20, 2015 to around October 20, 2015, the Defendant used the aforementioned electronic records to exercise his/her rights and duties on the mobile phone for the purpose of performing business affairs over a total of 14 hours, as shown in attached Table 1 and attached Table 1.

2. Around September 29, 2015, the Defendant forged a private document and uttering of a falsified document using a copy of I’s identification card stored therein at the office of “D” and entered “I”, “J”, “J”, etc. in the customer name column of the application for mobile phone membership in the cellular phone subscription column with a fold-type clocked copy of the I’s identification card, and signed arbitrarily on the I’s name. Around that time, the Defendant sent the forged mobile phone application form via facsimile as if he had been genuinely constituted, and then, the Defendant’s rights and duties for the purpose of exercising it over three times in total, such as attached Table 2, from around that time to November 18, 2015.
