Punishment of the crime
[2019 Highest 5396] The name-based financial fraud is the general responsibility of the organization of a telecommunications-based financial fraud (i.e., one type of fraud) that brings the money kept by the victim by making a false statement against an unspecified victim, such as the public prosecutor, police officer, etc., misrepresenting himself/herself an investigative agency, and “to withdraw and keep in a designated place the money deposited in the lower account due to a crime committed in the name of the victim,” and the defendant takes the role of collecting the money kept by the victims under the direction of a person who has no name to receive the money and remitting the money to the account managed by the organization of the crime.
On July 1, 2019, the Defendant, through “C” in the early Malaysia, had engaged in delivering money to the Republic of Korea, to the extent of KRW 600 to KRW 700- KRW 1700- KRW 200,00 per day.” The Defendant conspired with the members of the organization of the crime in succession with the Defendant, by having the Defendant contact with the name-in-factor who posted the advertisement with “D” and to perform the work. Accordingly, the Defendant entered the Republic of Korea around July 10, 2019.
1. Fraud;
