Reasons
Punishment of the crime
[Criminal Power] On November 11, 2011, the Defendant was sentenced to five months of imprisonment for fraud at the Seoul Western District Court on April 9, 201 and completed the execution of the sentence at the Seoul Southern Southern District Court on April 2012.
[2015 Highest 1780] On December 2, 2014, the Defendant introduced the victim D, who is in Eunpyeong-gu Seoul, as an employee, to the E dan, the victim D’s work as an employee, and made a false statement that “The Defendant made an investment that would be able to make an investment to the Investment Finance Company that became aware of in the course of photographing in the MBC, so it would be able to obtain a large amount of profit.”
However, it is not only the defendant MBC shooting supervision, but also there is no certain occupation or income, and there is no particular property, so it was thought that the investment funds received from the victim will be used for private purposes, such as living expenses, and there was no intention or ability to pay profits
On December 2, 2014, the Defendant, by deceiving the victim as such, received KRW 3 million from the victim to the new bank account in the name of the Defendant on December 2, 2014, including remittance of KRW 3 million under the name of investment, from around that time to March 13, 2015, as shown in the separate crime list, and received delivery of KRW 40 million in total over 12 times, as shown in the separate crime list.

On October 2014, the Defendant made a false statement to the effect that “B has been employed as a manager of MBC shooting and invested in tvN shares in the past, and the said shares are not stocks that can be traded by the general public, and thus are not stocks that can be traded by a trade union employee, the Defendant made a false statement to the effect that “I will make an investment in the future that would give him an opportunity to pay the dividend of the shares through a trade union employee,” in the G hotel rest room located in Seocho-gu Seoul Metropolitan Government F.
However, the defendant was thought to use the investment funds received from the victim for private purposes, such as living expenses or light hosting, due to the lack of work by MBC shooting supervision or investment in the tvN shares.
