Punishment of the crime

The defendant, who is a child and intellectual disability in the third degree of disability, was suffering from the victim B (n, August 205, 2005), and the victim's mother C went out to contact with the victim's continuous drinking violence since five years ago, and the victim's father (the death of February 2018) was living in the hospital due to high blood pressure and urology, and there were no parents.

As above, the victim, who was a child with intellectual disability, had no choice but to believe that he/she was the same as his/her parents, and was unable to refuse the request of the defendant. The defendant was also aware that he/she was incapable of being aware of the victim's lack of recognition ability, using the fact that he/she could not easily refuse his/her request due to the absence of biological parents to engage in sexual intercourse with the victim.
