피고인은 2016. 5. 9. 23:26 경 대구시 남구 C에 있는 대구 남부 경찰서 D 지구대에서, 술에 취하여 큰 소리로 “ 시청에 고발하러 간다, 내가 적어 놓은 버스번호가 틀려 조회가 안된다고 하니 여기서 조회를 해 달라” 고 말하며 소란을 피우고, 그 곳 경찰관들 로부터 귀가 권유를 받았음에도 23:26 경부터 다음날 00:43 경까지 수회에 걸쳐 지구대 안으로 들어와 경찰관들에게 “ 이 시발쌔끼가 ”라고 큰 소리로 욕설을 하는 등 소란을 피웠다.
