Reasons
Punishment of the crime
1. However, in fact, since the defendant did not engage in the game development business and intended to make a stock investment by providing funds, there was no intention or ability to pay the profits through the development of the game by receiving the investment money.
The Defendant, by deceiving the victim as such, received from the victim a transfer of KRW 129 million to a new bank account (G) in the name of the Defendant on the same day under the name of the Defendant for investment, and received a total of KRW 130 million from the same account around October 10, 2012.
2. On March 1, 2013, the Defendant, via the above F, posted the victim’s home before the said victim’s E, to the effect that “If the victim bears KRW 20 million for each of the mobile game businesses, he/she may run the mobile game business. Prior to his/her own relative, he/she may run a long time in the game company, and bring the game into the Kakakao Kakao Stockholm.” The Defendant presented the game to the effect that “I talk about a talk at A’s home located in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul.” The Defendant directly displayed No. 130 million won for the victim in the coffee shop located in Dongdaemun-gu Seoul, Dongdaemun-gu, Seoul, to the effect that “I am in this game,” and that “I am in this amount of KRW 20 million and KRW 50 million for the remainder of KRW 500,500,500,500,500,000.”
However, in fact, since the defendant did not engage in a game-related business and intended to make stock investments by providing funds, it is intended to receive investment money and purchase a game or make an investment in a game business.
