1. The plaintiff (appointed)'s claim is dismissed.

2. The costs of lawsuit shall be borne by the plaintiff (appointed party).

In light of the above, if the Defendant pays KRW 130,00 out of the daily transport earnings to the Defendant, then the Defendant paid the Defendant the basic pay for drivers in the taxi commission that the Defendant received, and the drivers paid the transport earnings in excess of the taxi commission, in the form of full income.

(3) From July 1, 2010, the amended Minimum Wage Act was enforced. The Defendant and the Cultural taxi trade union made efforts to conclude a new wage agreement from September 2009 prior to the enforcement of the Minimum Wage Act. However, in the end, after the enforcement date of the Minimum Wage Act, the wage agreement with the following contents (hereinafter “new wage agreement”) was concluded on April 30, 201.

Article 1 (Basic Policy)* The Government's policy by mutual agreement between labor and management and by the Minimum Wage Act is to establish a foundation for the growth of cooperative lives between labor and management, and to enhance the welfare of union members and the rate of operation of vehicles.

* Deposits shall be 169,000 won, and the basic salary shall be 516,000 won.

Other allowances, etc. shall be paid according to the number of years in continuous service in the wage calculation table.

Article 3 (Types of Work) * In principle, two-schoolwork per day shall be conducted.

However, due to the unique characteristics of taxi transportation business, regional characteristics, etc., labor-management may agree on a day-day work system.

* If a person works under the proviso to the preceding paragraph, he/she shall be recognized as a full-time worker on 12th day of each month.

Article 4 (Working Hours) * Working Hours shall be five hours a day, twenty minutes a day, and thirty-eight hours a week, excluding break time.

However, 10 hours a day (from the time to the time of entry) shall be 10 hours a day, and the hours excluding 5 hours and 20 minutes of basic working hours (4 hours and 40 minutes) shall be the break time, and the break time shall be the break time of the driver and the driver shall be freely used during
