A defendant shall be punished by imprisonment for one year.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

Defendant 2, “2015 Gohap 397,” is a business owner who has performed logging work from January 29, 2015 with respect to standing timber in Pyeongtaek-gun D and 15 parcels.

1. The business owner who has not been designated as the sloping and sheltering place shall take measures necessary for the prevention of hazards caused by improper work methods, etc. in the course of excavating, quarrying, stevedoring, loading and unloading, timbering, transporting, operating, dismantling, handling heavy objects, and other work, and the business owner shall, by detailed safety measures therefor, set the course and shelter place in advance;

Nevertheless, on February 3, 2015, the Defendant did not set a shelter route and place in advance and caused the death of an external cerebral cerebral cerebral ties by a worker E, who was engaged in the felling operations at around 10:00, around 10 meters away from approximately 30 meters high-level vain tree suffering from about 10 meters in vain tree.

2. A business owner who wears safety caps shall take measures necessary to prevent such danger in a place where his/her employees might fall down at work, where sand, structures, etc. might collapse, where material objects might fall or come by flying off, or where other danger may occur due to natural disasters in the course of his/her work, and the business owner shall ensure that he/she wear safety caps by paying more than the number of workers engaged in his/her work for which material objects might fall or work at the risk of fall by his/her employees due to specific safety measures therefor;

Nevertheless, the Defendant did not pay safety caps to workers E and did not require them to wear them, and caused the death of cerebral cerebral cerebral ties by facing two parts on the left side of the trees used by the above E as referred to in paragraph (1) at the time and place of paragraph (1).
